What Does HB 331 Say About Toilet Training Requirements for Kindergarten Enrollment?
With the passing of HB 331, beginning on May 1, 2024, students must be toilet trained before being enrolled in kindergarten. The Utah State Board of Education (USBE) created rules to implement the law, which defines toilet training as being able to:
- Communicate toileting needs to adults
- Sit on the toilet
- Use the toilet without help
- Dress and undress
- Maintain hygiene after using the bathroom
What does this mean if your student is a student with a disability?
This law includes exceptions for students with disabilities or other conditions. For example, a school can enroll a student who isn’t toilet trained if their developmental delay is due to a condition addressed in an Individual Education Plan (IEP) or Section 504 plan. It is important as parents and caregivers to work with your school teams to help ensure your student receives the support they need.
